1. General provisions
The Aireclaims´s Terms and Conditions contain a detailed description of every capitalised term used in the Price List. The Price List applies to payments in relation to the Flight Compensation Regulation. If Aireclaim provides additional services, the corresponding sums are paid according to terms that have been separately agreed upon.
2. No fee for submission of the Claim
If flight compensation is not obtained from the flight operating carrier (airline), Aireclaim does not charge anything for pursuing the claim.
3. Aireclaim's comission
If the claim is successful and the amount is received from the airline, Aireclaim shall deduct its agreed remuneration directly. In such cases, Aireclaim is entitled to a commission of 30%, to which applicable VAT and a handling fee are added.
No handling fee applies to payments up to €99.99. For higher amounts, a handling fee of €15 is charged for payments between €100 and €199.99, €25 for amounts between €200 and €599.99, and €40 for payments of €600 or more.
In situations where an amicable settlement with the airline cannot be reached, the case shall be escalated to litigation. In such instances, Aireclaim is entitled to increased remuneration to cover the additional costs associated with legal proceedings, such as court fees, translation expenses, attorney services, and administrative work. In this case, a commission of 50% shall apply, in addition to VAT and the handling fee.

The amounts above include VAT and other fees.
To reduce this fee, in case of shared bookings we will transfer all payments to a single account if the other persons (minors excluded) give us clearance to do so.
In case of non-SEPA payment there is a €10 fee (examples: non-euro currency, other payment method like Paypal, WU, etc),
Cash or cheque payments are not available.
If our payment fails due to a reason of your responsibility – ex: wrong bank data- we will repeat payment, deducting bank charges if any plus a 10€ fee for administrative work.
4. Value Added Tax (VAT)
VAT is established by the law and is currently 23% in Portugal, so a 30% commission results in 6.9% tax.
5. Expiry of Payment Due to Inactivity
If, after four email notifications of successful compensation, the client fails to provide valid bank account details or an alternative payment method within three (3) months, the right to receive the payment shall be considered expired. Aireclaim reserves the right to redirect the unpaid amount to a charitable cause or other appropriate destination.
6. Retention of Financial Records
Due to regulatory requirements, especially regarding EU audits, bank transaction records and other documents related to the client’s case shall be retained for a period of five (5) years. During this time, clients agree not to request the deletion of such data.
