General Data Protection Regulation (GDPR)


We consider data privacy to be essential to conducting business. The goal of our privacy statement and procedures is to process personal data in a way that is appropriate, legal, and provides confidentiality, integrity, and availability.

The whole online privacy policy that applies to our operations is embodied in this Privacy Statement. The types of information we gather, as well as how we use, distribute, and protect the data you give us, are described in the Privacy Statement. Personal data

Principles

The following data protection guidelines form the foundation of our privacy statement:

  • Personal data must be processed in a fair, transparent, and legal manner.
  • Personal information must only be gathered for clear, specific, and justifiable purposes; it cannot be processed further in a way that conflicts with those goals.
  • The amount of personal information that is gathered must be sufficient, pertinent, and kept to a minimum given the reason for processing.
  • The personal information must be correct and updated as needed.
  • Every reasonable effort must be made to guarantee that erroneous personal data, taking into account the reasons for processing, is promptly deleted or corrected.
  • Personal information must only be retained in a form that allows for identification for as long as is required to fulfil the processing purpose.
  • All personal information must be kept private and stored with the proper security in place.
  • Unless the transfer is required to enable Aireclaim to provide the services outlined in the agreement, personal information will not be disclosed to third parties.
  • You are entitled to data portability, processing restriction, access to, and rectification or erasure of personal data, as well as the capacity to object to processing.


Collection and use of personal data

We may ask for personal information from you if you want to use our services or send us information. This is so that we can run and grow our business and services. You can send us personal information through our website, email, the mail, other internet or software tools we offer, or by calling us. All personal information is gathered in line with the laws that protect it. We will only use personal information to the extent needed for a clear, stated, and legal reason or to the extent needed by law in the places where we do business.

Names, dates of birth, addresses, email addresses, phone numbers, cards or IDs, and national identification numbers are the main types of personal information we collect. We need this personal information to provide our service, as this is the core activity of Aireclaim as a business.

In addition, we gather personal information for other reasons, like keeping track of numbers, communicating and managing IT and security, making sure buildings are safe, setting up authentication and authorisation systems, helping with internal projects, and managing organisational teams and activities.

We buy information about planes from outside sources, like when flights are delayed or cancelled within a certain time frame, etc. This is non-personal data that we put together with personal data. Our eligibility service is only used to let people know how likely it is that they have a valid claim.

If you give us personal information about fellow passengers, you must make sure that all of those fellow passengers have given their clear permission for us to share that information with our organisation, as required by data security laws. Additionally, you are expected to give the fellow passengers access to our privacy policy so that they are fully aware of how we use their information.

We may need more details or documents from you about fellow passengers. Because of this, we will not be able to help that fellow passenger if you or they do not give us the necessary information and/or papers. Consequently, we will have to delete that fellow passenger’s personal information from our records, and we will not be able to offer our services to them.

All personal data collected and processed by Aireclaim is based on one or more of the legal grounds provided by Article 6 of the General Data Protection Regulation (GDPR), including:

  • The processing is necessary for the performance of a contract to which the data subject is party (e.g. to provide legal assistance services);
  • The processing is required for compliance with a legal obligation (e.g. anti-money laundering regulations, tax requirements);
  • The processing is carried out in the legitimate interest of Aireclaim (e.g. IT security, fraud prevention, service improvement), provided that such interests are not overridden by the data subject’s rights;
  • The data subject has given clear, informed and specific consent (e.g. for receiving marketing communications).

The specific legal basis applicable to each processing activity can be provided upon request by contacting the Data Protection Officer (DPO).


Use of personal data

We will only use personal information for the reason it was given to us and for no longer than is needed for that reason. We may keep your information for as long as your account is current or as long as it takes to provide services, meet our legal obligations, or do any of the other things listed above. Employees of Aireclaim are the only ones who can access personal data. They have to be authorised to do so by Aireclaim and have a clear business need for the data.

Data Retention Period

Personal data will be retained only for as long as necessary to fulfil the purposes for which it was collected, including to comply with legal, contractual, accounting, or reporting requirements. In general:

  • Case-related data will be retained for up to five (5) years following the closure of the case or final payment, whichever occurs last;
  • Personal data processed for marketing purposes will be retained until consent is withdrawn;
  • Data collected solely for eligibility checks and never resulting in a signed agreement will be retained for a maximum of twelve (12) months.

Retention periods may be extended if required by legal obligations or for the establishment, exercise, or defence of legal claims.


Automated Processes and Profiling

Aireclaim does not rely on automated processing in accordance with the article. 22 p. 1 of the GDPR, and your personal data will not be used for profiling purposes. Your information will not be used for these reasons unless you tell us otherwise and give your separate permission.

But we might be able to handle some tasks with our own technology and the technology of our partners. We can now serve you faster and better because of this. Our teams check these automatic processes often to make sure they are correct and don’t have any bad or unnecessary effects on you. This has to do with past and future events. Sharing of personal data

 We will only transfer the personal data to third parties under the conditions as listed below:

  • if you have given consent;
  • if it is directly linked to the reason the personal data was collected in the first place;
  • if it’s needed to prepare for, negotiate, and carry out the deal with you;
  • as long as it’s needed by law, an official order, or a court order;
  • if it’s needed to make or protect legal claims or to defend proceedings in court;
  • if it is needed to legally comply with requests from public officials, such as to protect national security or meet law enforcement needs;
  • to make sure data protection, if it stops misuse or other illegal activities, like attacks that are done on purpose,

We sometimes hire other businesses and companies, both inside and outside the European Economic Area. For example, we might hire lawyers to take legal action or tech companies to improve our products and services. When this happens, we will share the information that is needed. Before we give out personal information, we make sure that the other party agrees to keep it safe by signing a written deal that includes data protection terms that follow Data Protection Laws.

Service companies will only be able to get the personal information they need to do their job. We will not give your personal information to outsiders so that they can market their goods or services to you. Security of processing

We care about the safety of your personal information. When we handle personal information, we will do so safely. We will use and keep up with appropriate and generally accepted standards for technical and organisational measures to protect personal information from being accidentally or unlawfully deleted, lost, changed, shared without permission, or accessed, especially when data is sent over a network, as well as from all other illegal forms of processing. Your data protection rights

You have the right to request your personal data, have it corrected or erased, have processing limited, refuse to processing, and be able to move your data to another person at any time. To help us keep personal information up to date, please let us know about any changes or errors. Please email the DPO at geral@aireclaim.com if you want to see and/or change personal data, find out how long we plan to keep personal data, or ask any other questions about access to personal data. You can also email the DPO if you want to know if we hold any of your personal data or process it on behalf of a third party. We’ll get back to you as soon as possible regarding your request.


Marketing and advertising communications

We can send marketing emails as long as the recipient agrees. This kind of permission has to be given voluntarily, be clear, detailed, informed, and free of any doubts. You meet these conditions when you “opt-in,” which means you voluntarily agree to receive business emails.

You can always say no to the processing of your personal data for direct marketing reasons, whenever you want, and it will not cost you anything. Simply let them know you want to do this. You can stop getting marketing emails from us by going to our cancel page, clicking on the “Unsubscribe” link in any email we send you, or emailing us at geral@aireclaim.com. Your personal information will not be used for direct marketing if you say no.

We think you might be interested in the information in the marketing emails, like the newest information about our goods and services.

A third party works with us to put ads on our website or handle our ads on other websites, such as social media sites. Our third-party partner may use cookies or other similar technologies to show you ads based on what websites you visit and what you like. You can choose not to see ads based on your interests. Please keep in mind that you will still be getting general ads.


Complaint

You have the right to make a complaint about how we handle your personal information. All questions and issues must be answered quickly and correctly by the DPO in line with company policies. You can send complaints to the DPO at geral@aireclaim.com.

f you think that the way we handle your personal information breaks any Data Protection Laws, which is very rare, you can also file a complaint with the appropriate supervisory body.


Changes to this Privacy Statement

This Privacy Statement may be changed from time to time, for example if the law changes or if our company structure changes. If there are any important changes, you will be told by email or a notice on the website before the change takes effect. Please check this page from time to time to get the most up-to-date information on how we handle your privacy.
